Subject: 9653/Amend Code/Art III/Temporary Assignments Date: Tue, 3 Dec 1991 12:15:00 -0500 ORDINANCE NO. 9653 AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE, PART II, ARTICLE III, BY ADDING THEREIN A NEW SECTION RELATIVE TO LIMITING TEMPORARY OR INTERIM ASSIGNMENT OF EMPLOYEES TO DEPARTMENT HEAD STATUS TO A NINETY (90) DAY PERIOD, AND RETURNING ALL EMPLOYEES WHO HAVE ENJOYED HIGHER PAY AS A RESULT OF SUCH ARRANGEMENTS TO THEIR FORMER POSITIONS AND COMPENSATION AFTER 90 DAYS. WHEREAS, the Charter of the City of Chattanooga requires that department heads shall be nominated by the Mayor and confirmed by the City Council; and WHEREAS, it is recognized that vacancies occur from time to time which require the filling of such positions on a temporary or interim basis, pending selection and confirmation of a permanent appointee; and WHEREAS, it is essential that such temporary assignments not become a means of de facto circumvention of the City Charter; SECTION 1. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Part II, Article III, Chattanooga City Code, be amended by adding thereto a new section to provide as follows: Temporary or interim assignments of employees to department head status shall not continue for more than 90 days and all such employees who have operated above their normal pay grade and step shall be returned to their normal pay grade and step and shall be returned to their regular salary and benefits at the expiration of 90 days or upon the confirmation of a new department head, whichever shall first occur. SECTION 2. BE IT FURTHER ORDAINED, That all employees who have enjoyed higher pay as a result of such arrangements for more than 90 days as of the effective date of this ordinance shall be returned after 90 days to their permanent assignments and compensation unless confirmed as the permanent department head. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two (2) weeks from and after its passage, as required by law.
